Terms of Service

1. Acceptance of Terms

By accessing or using Leadber ("Service"), operated by Leadber Pte. Ltd., you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Leadber is an AI-powered B2B lead generation and WhatsApp outreach platform. The Service scrapes publicly available business contact information and enables automated or semi-automated outreach via WhatsApp and other channels.

3. Permitted Use

You may use the Service only for lawful B2B marketing purposes. You must:

  • Only contact business entities and their representatives
  • Immediately honour any opt-out or STOP request
  • Comply with all applicable anti-spam and data protection laws
  • Not use the Service to send unsolicited personal marketing (B2C spam)
  • Not attempt to scrape competitor platforms through the Service

4. Data Residency & Compliance

All customer data is stored on AWS infrastructure located in the Singapore (ap-southeast-1) region. Leadber is designed to assist compliance with:

  • Singapore Personal Data Protection Act (PDPA)
  • EU General Data Protection Regulation (GDPR) for EU-based users
  • Vietnam's Decree 13/2023/ND-CP on personal data protection

You remain the data controller for all lead data you collect through the Service. Leadber acts as a data processor.

5. Opt-Out Mechanism

Leadber automatically processes STOP/UNSUBSCRIBE replies received via WhatsApp. When a lead replies with STOP, their status is permanently set to OPTED_OUT and no further messages will be sent. You are prohibited from manually overriding this status to re-contact opted-out leads.

6. Credits & Billing

Access to the Service is governed by a credit-based system. Credits are consumed per scrape action and per outreach message. Credits are non-refundable except where required by applicable law. Unused credits expire 12 months from purchase.

7. Intellectual Property

Leadber and its original content, features, and functionality are owned by Leadber Pte. Ltd. and protected by international copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

The Service is provided "AS IS" without warranty of any kind. Leadber does not warrant that scraped data is accurate, complete, or up to date. You use scraped data at your own risk and are responsible for verifying its accuracy before outreach.

9. Limitation of Liability

To the maximum extent permitted by law, Leadber shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including any fines or penalties you incur for non-compliance with applicable laws.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason at our sole discretion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions.

12. DNC/PDPA Compliance & Indemnity

By using Leadber's outreach features, you agree that you are solely responsible for compliance with all applicable laws including Do Not Call (DNC) registries, PDPA, GDPR, and any local data protection regulations. Leadber provides tools only and accepts zero liability for how you use them. You indemnify Leadber fully against any claims arising from your outreach activities.

It is your responsibility to:

  • Check all applicable DNC registries before contacting any individual
  • Obtain proper consent where required by local data protection laws
  • Honor all opt-out and unsubscribe requests immediately
  • Maintain records of consent as required by applicable regulations
  • Comply with PDPA (Singapore), GDPR (EU), CAN-SPAM (US), and equivalent local laws
